These Terms of Service apply to your use of www.financewithzanele.co.za and the online courses, downloadable resources, educational content and related services available through the website.

Finance with Zanele is operated by Finance with Zanele (Pty) Ltd (“Finance with Zanele”, “we”, “us” or “our”).

Our online store is hosted by Shopify, and our courses may be delivered through Tevello or another course-delivery platform.

By accessing our website, creating an account, purchasing a product or using our services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use the website or purchase our products.

  1. EDUCATIONAL PURPOSE AND FINANCIAL DISCLAIMER

Unless expressly stated otherwise, the content on this website and in our courses, calculators, workbooks, newsletters and downloadable resources is provided for general financial education and information.

It does not constitute:

  • Personalised financial advice

  • A personal financial plan

  • Tax, legal or accounting advice

  • An offer or recommendation to purchase, replace or cancel a financial product

  • A guarantee of any financial or investment outcome

  • A registered academic qualification

  • Continuing professional development accreditation

Examples, projections and illustrations are provided to explain financial concepts. They are based on assumptions and may not reflect your actual circumstances, costs, tax position or future results.

Investment values and returns can increase or decrease. Historical or assumed returns do not guarantee future performance.

  1. ELIGIBILITY AND CHILDREN

You must have the legal capacity to enter into a binding agreement to make a purchase or create a paid account.

Where a course or resource is purchased for a person under 18, the purchase and account creation must be completed or appropriately authorised by a parent, legal guardian or other competent person where required by South African law.

Parents and guardians are responsible for supervising a child’s use of the website, courses and resources.

Children should not submit unnecessary personal, financial, medical or account information through the website.

  1. ACCOUNTS AND INFORMATION

You may be required to create an account to access a course or digital resource.

You agree to provide information that is accurate, current and complete. You are responsible for:

  • Keeping your login details confidential

  • Using a secure password

  • Updating your contact information

  • Preventing unauthorised access to your account

  • Activities performed through your account

You may not sell, transfer, share or provide your course account or login details to another person.

Notify us promptly at zanele@financewithzanele.co.za if you believe that your account has been accessed or used without authorisation.

  1. ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase the selected product or service.

An order is accepted once:

  • Payment has been successfully processed;

  • We have issued an order confirmation; and

  • The relevant course or digital resource has been made available or confirmed.

We may decline or cancel an order where:

  • Payment is unsuccessful, reversed or suspected to be unauthorised;

  • Pricing or product information contains a material error;

  • Fraud, misuse or unlawful activity is suspected;

  • A product is no longer available;

  • A technical problem prevents us from providing the product; or

  • We are legally required to do so.

If we cancel a fully paid order before providing access, we will refund the amount paid unless the payment is reasonably withheld because of suspected fraud, a chargeback or another lawful reason.

  1. PRICES AND PAYMENT

Prices are displayed in South African rand unless another currency is clearly stated.

The price payable is the price shown at checkout when the order is submitted.

Prices may change without prior notice, but a later price change will not alter a completed order.

Any applicable VAT or other taxes will be handled as displayed at checkout and on the relevant invoice or receipt.

Payments are processed by the payment provider displayed during checkout. We do not ordinarily receive or store your complete card number, PIN, card-security code or online-banking credentials.

You confirm that:

  • The payment information you provide is accurate;

  • You are authorised to use the selected payment method; and

  • Sufficient funds or credit are available to complete the transaction.

  1. DIGITAL DELIVERY AND COURSE ACCESS

Courses are generally made available electronically after successful payment.

Access instructions may be delivered through:

  • Your Finance with Zanele account

  • The course-delivery platform

  • An order-confirmation page

  • Email

  • A download link

You are responsible for providing a correct email address and checking your inbox, spam or junk folder.

If you do not receive access within a reasonable period after successful payment, contact zanele@financewithzanele.co.zaand provide your name, order number and payment reference. Do not send passwords, PINs or complete card information.

Course-access periods will be stated on the product page or during checkout. If a product is advertised as providing lifetime or unlimited access, this means access for as long as Finance with Zanele continues to operate and host that course, subject to these Terms and reasonable technical or platform changes.

We may migrate courses to another platform, update the access method or replace older materials with revised versions.

  1. DOWNLOADABLE RESOURCES AND CALCULATORS

Downloadable resources may include workbooks, templates, spreadsheets, calculators, checklists, guides and action plans.

You are responsible for:

  • Downloading and securely storing your purchased files;

  • Using compatible software and devices;

  • Keeping backup copies where appropriate;

  • Checking formulas and outputs before relying on them; and

  • Protecting personal financial information entered into downloaded resources.

Calculators and spreadsheets are educational tools. Their results depend on the accuracy of the information entered and the assumptions used.

We do not guarantee that a calculator, spreadsheet or example will reflect your exact tax position, financial-product terms, fees, inflation rate, investment performance or personal circumstances.

  1. COURSE COMPLETION AND CERTIFICATES

Where offered, a certificate of completion confirms that the learner completed the relevant Finance with Zanele course requirements recorded by the course platform.

Unless expressly stated otherwise, a certificate of completion:

  • Is not a registered qualification;

  • Does not award academic credit;

  • Does not confer a professional designation;

  • Is not proof of competence to provide financial advice;

  • Is not CPD-accredited; and

  • Does not authorise the holder to perform regulated financial services.

We may correct, suspend or withdraw a certificate issued because of a technical error, inaccurate information, account sharing, dishonesty or failure to satisfy the course requirements.

  1. REFUNDS AND CANCELLATIONS

Refunds and cancellations are governed by:

  • Our published Refund Policy;

  • The Electronic Communications and Transactions Act 25 of 2002;

  • The Consumer Protection Act 68 of 2008; and

  • Other applicable South African law.

Nothing in these Terms or our Refund Policy limits any mandatory consumer right that cannot lawfully be excluded.

Because online courses and downloadable products may be supplied or accessed immediately after payment, refund eligibility may depend on:

  • Whether access has already been provided;

  • Whether the course or resource has been accessed, streamed or downloaded;

  • Whether performance began with the customer’s knowledge or consent;

  • Whether the product is defective, materially misdescribed or inaccessible;

  • The reason and timing of the request; and

  • Any mandatory right available under applicable law.

A change of mind does not automatically create a right to a refund after digital content has been accessed or downloaded, except where applicable law provides otherwise.

If a course or resource is defective, materially different from its description or cannot be accessed because of a problem within our reasonable control, contact us so that we can investigate and provide an appropriate remedy.

Refund requests must be submitted to zanele@financewithzanele.co.za with the customer’s name, order number, purchase date and reason for the request.

  1. INTELLECTUAL PROPERTY

The website and its contents, including courses, videos, audio, text, graphics, photographs, branding, frameworks, workbooks, spreadsheets, calculators, templates, downloads and certificates, are owned by or licensed to Finance with Zanele and are protected by applicable intellectual-property law.

When you purchase a course or resource, you receive a limited, personal, non-exclusive, non-transferable and revocable right to access and use it for your own educational purposes.

You may download and print resources where the product permits this.

You may not, without prior written permission:

  • Copy or reproduce course materials for distribution;

  • Share downloads or login details with another person;

  • Upload materials to another website, platform or shared drive;

  • Sell, sublicense, rent or commercially exploit the materials;

  • Record, reproduce or redistribute course videos;

  • Remove copyright notices, logos or branding;

  • Modify materials and represent them as your own;

  • Use our course content to create or train a competing course, service or commercial product;

  • Use automated systems to extract or reproduce substantial parts of the website or course; or

  • Issue our materials to employees, clients, learners or group members under a single-user purchase.

Contact us for written permission or an appropriate group licence if you want to use the materials within a school, business, adviser practice, training programme or organisation.

  1. ACCEPTABLE USE

You may use the website only for lawful purposes.

You may not:

  • Attempt to gain unauthorised access to an account, server or system;

  • Interfere with the operation or security of the website;

  • Introduce malware or harmful code;

  • Circumvent access or content-protection measures;

  • Use false identities or payment information;

  • Commit fraud or facilitate unlawful activity;

  • Harass, threaten or unlawfully discriminate against another person;

  • Scrape, harvest or collect personal information without permission;

  • Infringe our rights or the rights of another person;

  • Publish unlawful, defamatory or misleading content; or

  • Use the website in a manner that could damage Finance with Zanele, Shopify, Tevello or other users.

We may suspend or terminate access where we reasonably believe these Terms have been breached or where this is necessary to protect customers, systems, content or legal rights.

  1. THIRD-PARTY PLATFORMS AND LINKS

Our services may rely on third parties such as:

  • Shopify

  • Tevello

  • Payment processors

  • Email and newsletter platforms

  • Video-hosting services

  • Booking and communications platforms

  • Analytics and security providers

Third-party services operate according to their own terms and privacy policies.

We are not responsible for the independent content, availability, security or practices of third-party websites. However, this does not remove any responsibility that applicable law places on us for services we have agreed to provide.

Shopify supplies the ecommerce technology used by our store, but purchases made through the store are made directly from Finance with Zanele.

  1. REVIEWS AND FEEDBACK

If you submit a review, testimonial, suggestion or other feedback, you confirm that:

  • It reflects your honest experience or opinion;

  • You have the right to submit it;

  • It does not unlawfully infringe another person’s rights; and

  • It is not defamatory, deceptive, abusive or unlawful.

You give us permission to use, reproduce and display the feedback for operating, improving and promoting Finance with Zanele.

We will request additional permission before publishing personal information or a testimonial in circumstances where consent is required.

You may contact us if you want us to stop using a testimonial linked to your identity. We will consider the request in accordance with applicable law and any material already lawfully produced or published.

  1. ACCURACY AND UPDATES

We aim to provide accurate, clear and useful information, but financial laws, tax rules, contribution limits, product terms, statistics and market conditions can change.

Content is generally accurate as at its stated publication or update date.

We may correct errors and update or withdraw content without notice. You should confirm important current information before making a financial decision.

Course updates may include changes to:

  • Lessons and module structures;

  • Workbooks and downloads;

  • Examples and calculations;

  • Legislation and tax information;

  • Platform features; and

  • Course names or visual presentation.

  1. AVAILABILITY AND TECHNICAL INTERRUPTIONS

We do not guarantee that the website or course platform will always be available without interruption.

Access may be affected by:

  • Maintenance;

  • Platform outages;

  • Internet or device problems;

  • Cybersecurity incidents;

  • Updates or migrations;

  • Events beyond our reasonable control; or

  • Closure or replacement of a third-party service.

Where reasonably possible, we will take appropriate steps to restore access or provide an alternative where a significant problem within our control prevents access to a paid product.

  1. WARRANTIES AND CONSUMER RIGHTS

We provide the website, courses and resources with reasonable care and skill.

To the extent permitted by law, we do not warrant that:

  • Using a course will produce a particular financial result;

  • A learner will save, earn or invest a particular amount;

  • Educational material will be suitable for every individual;

  • A third-party platform will always be uninterrupted; or

  • Every error or technical problem can be prevented.

Nothing in these Terms excludes a warranty, right or remedy that cannot lawfully be excluded under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable South African law.

  1. LIMITATION OF LIABILITY

To the extent permitted by law, Finance with Zanele will not be liable for indirect, incidental, special or consequential losses arising from:

  • Decisions made solely in reliance on general educational content;

  • Incorrect information entered into a calculator or worksheet;

  • Unauthorised sharing of account details;

  • A user’s device, internet connection or software;

  • Third-party services outside our reasonable control; or

  • Use of materials in breach of these Terms.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability arising from gross negligence or other liability that cannot lawfully be limited.

Any limitation must be interpreted consistently with applicable consumer-protection law.

  1. PRIVACY

Personal information is processed according to our Privacy Policy and applicable South African data-protection law, including the Protection of Personal Information Act 4 of 2013.

By using the website, you acknowledge that Shopify and other authorised providers may process information necessary to provide ecommerce, payment, course-delivery, communications, security and related services.

Please read our Privacy Policy before creating an account or making a purchase.

  1. SUSPENSION AND TERMINATION

We may suspend or terminate access where:

  • These Terms are materially breached;

  • Course content or login details are shared without permission;

  • Payment is reversed, disputed or fraudulent;

  • The website or platform is misused;

  • Access creates a security or legal risk; or

  • We are required to do so by law.

Where appropriate, we will provide notice and a reasonable opportunity to resolve the issue.

Termination does not affect rights or obligations that arose before termination. Intellectual-property, payment, privacy, liability and dispute provisions that should reasonably continue will survive termination.

We will attempt to resolve complaints reasonably and in good faith.

If a consumer complaint cannot be resolved directly, you may have the right to approach an appropriate South African consumer-protection body, ombud, regulator or court.

Nothing in this section prevents either party from seeking urgent legal relief where appropriate.

  1. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa.

Subject to any mandatory consumer right concerning jurisdiction or dispute resolution, disputes will be dealt with by a court or tribunal with lawful jurisdiction in South Africa.

  1. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

  1. NO WAIVER

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

A waiver is effective only if it is clearly given in writing by an authorised representative.

  1. CHANGES TO THESE TERMS

We may update these Terms when our services, products, platforms or legal obligations change.

The latest version will be published on this website with an updated date.

Changes will apply from the stated effective date. They will not retrospectively remove rights that arose from an order already accepted, unless required by law or agreed with the customer.

  1. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Refund Policy and any product-specific terms displayed before purchase, constitute the agreement governing your use of the website and relevant purchase.

If product-specific terms conflict with these Terms, the product-specific terms apply only to that product and only to the extent of the conflict, subject to applicable law.
